1. Circuit Training Workout
1.1 “Circuit Training Workout” refers to Circuit Training Workout (parent company) or any of its associated franchises
2. Operation
2.1 Only Circuit Training Workout (owned and operated by Mr. Liam James Tatton-Bennett) or any person sub-contracted by Circuit Training Workout or any of its associated franchises shall manage and operate Circuit Training Workout and deal with all matters in relation to it.

3. Membership
3.1 Details of each type of membership are available on the Circuit Training Workout website.
3.2 Other categories of membership may be stipulated by Circuit Training Workout from time to time.
3.3 Memberships shall be determined on an individual basis.
3.4 The decision to accept the application of a potential member shall be at the sole discretion of Circuit Training Workout.
3.5 Circuit Training Workout reserves the right to verify or require proof of information given in order to obtain Key Worker membership status and any fraudulent or wrongful information given to obtain such membership could result in the cancellation of relevant membership rights and lead to the repayment of associated payments by the member to Circuit Training Workout. Circuit Training Workout may request, at its sole discretion, new eligibility proof for continued Key Worker membership status to be granted.
3.6 Where a membership application is accepted by Circuit Training Workout, membership will be confirmed by way of a confirmation email containing details of membership and membership expiry date. A wristband specifying the date of relevant membership expiry will also be issued to Bronze, Silver or Gold Circuit Training Workout members.
3.7 Membership wristbands will normally be renewed at the point of membership renewal to Bronze, Silver or Gold Circuit Training Workout members. These members will be required to wear their membership wristbands when attending Circuit Training Workout sessions and show their membership expiry date (printed on their wristband) to the relevant Circuit Training Workout instructor if required. Fraudulent use of membership wristbands may lead to the repayment of associated payments to Circuit Training Workout and/or termination of membership (with no membership refund payable) if deemed appropriate solely by Circuit Training Workout. Pay-as-you-go rates may be charged if Bronze, Silver or Gold Circuit Training Workout members do not have their wristband. Lost or damaged membership wristbands may be subject to a replacement charge being made by Circuit Training Workout.
3.8 The acceptance by Circuit Training Workout of an application for membership constitutes a legally binding agreement between the
member and Circuit Training Workout. The member agrees to be bound by the rules and regulations of Circuit Training Workout including those which are in force from time to time.
3.9 Only persons aged 18 or over may join as Circuit Training Workout members or participate in Circuit Training Workout pay-as-you-go sessions.
3.10 Members are required to book to attend Circuit Training Workout sessions on the Circuit Training Workout website. Sessions can also be block-booked by Bronze, Silver or Gold Circuit Training Workout members up to the point at which their Circuit Training Workout membership expires. Circuit Training Workout reserves the right to allow another member and/or pay-as-you-go user to use any session booked by a member if the member books but does not attend a session. Circuit Training Workout members can only book sessions for themselves and not on behalf of any other member. Payment is required prior to any Circuit Training Workout sessions being used unless otherwise stated.
3.11 Reasonable cancellation notice (as deemed appropriate solely by Circuit Training Workout) is required for all sessions booked by members and failure to provide this notice may result in fees being charged or booking privileges being suspended and/or revoked if deemed necessary by Circuit Training Workout.
3.12 Any extraordinary debts due to Circuit Training Workout by members are to be paid within 7 working days of a charge being made by Circuit Training Workout for these debts.
3.13 It is members’ responsibility to ensure that Circuit Training Workout has your most up-to-date contact information – this includes postal address, email address and phone numbers.
3.14 Circuit Training Workout will continue to use members’ details for marketing purposes on expiry of membership unless a request has been received by Circuit Training Workout to have these details deleted accordingly.
3.15 Members are welcome to bring their children or pets with them when attending sessions (subject to local rules) however members have the sole responsibility for their children or pets when they are not involved in a Circuit Training Workout activity and members must supervise accompanying children or pets at all times during sessions.
3.16 Circuit Training Workout uses photographic images and audio/video recordings of members for general publicity in publications, on its website, on social media, in promotions and advertising, etc. Your attendance at Circuit Training Workout sessions or events constitutes your consent for Circuit Training Workout to capture and/or use your image or likeness without remuneration. Circuit Training Workout does not collect release forms from its members or guests for the use of images or films that it takes. Circuit Training Workout understands that there may be members who may wish to not be photographed or have their image used for publicity purposes by Circuit Training Workout. These members can opt-out by requesting a Photo Opt-Out form from Circuit Training Workout. Unless a completed Photo Opt-Out Form is on file, your image and/or likeness may at any time be captured by still photography, videography, or other photographic or electronic means. Circuit Training Workout reserves the right to use any such image, photograph, video, or the like for marketing purposes. Members who have completed a Photo Opt-Out form are responsible for notifying the camera/video operator of their opt-out status, and/or for removing themselves from any event where photographs/videography are in use. Failure to do so may result in the members’ inclusion in a photograph or recording and will be treated as a release, allowing the Circuit Training Workout to utilize that photograph or recording accordingly.
4. Changes to membership
4.1 New Silver and Gold Circuit Training Workout members reserve the right to cancel their Circuit Training Workout membership by sending an email to [email protected] within 30 days of the date that they originally became a Silver or Gold Circuit Training Workout member. If new Silver or Gold members cancel their membership within this cooling-off period then Circuit Training Workout shall refund them any upfront membership payments they may have paid. Bronze Circuit Training Workout members have 7 days from the date that they originally became a Bronze member to cancel their membership.
4.2 Existing members have the right to cancel at any time during their membership, however (except in reasonable circumstances as determined solely by Circuit Training Workout) normally no refunds of any membership payments will be payable to members who cancel their membership outside of the initial 30 days cooling-off period (for Silver and Gold members) or 7 days cooling-off period (for Bronze Members)
5. Membership Freeze
5.1 Bronze, Silver or Gold Circuit Training Workout members who are not able to access Circuit Training Workout sessions due to illness, injury or pregnancy (or for any other reason deemed as acceptable solely by Circuit Training Workout) must contact Circuit Training Workout to apply for a membership ‘freeze’. In these circumstances, Circuit Training Workout will normally simply extend the relevant membership expiry date (with no associated payments being due) to coincide with the length of the membership freeze. Membership freezes are normally only applicable for a maximum of three months. Members will need to contact Circuit Training Workout as soon as possible once they intend to apply for a membership freeze.
5.2 Freezing your membership will not cancel your membership. In order to cancel your membership, you must follow the procedure in either clause 4.2 or 4.3.
5.3 In the event of an Act of God, pandemic, emergency or any such similar situation Circuit Training Workout may freeze memberships automatically. (See Clause 5.1 for details of how membership payments will be affected in these circumstances)
6. Privacy and Data Protection Policy
6.1 Data Protection Legislation means any data protection legislation from time to time in force in the UK including the Data Protection Act 2018 or any successor legislation and (for so long as and to the extent that the law of the European Union has legal effect in the UK) the General Data Protection Regulation ((EU) 2016/679) and any other directly applicable European Union regulation relating to privacy. Data Controller, Data Processor, Data Subject and Personal Data take the meaning given in Data Protection Legislation.
6.2 Circuit Training Workout is a Data Controller of Personal Data provided to it for this agreement. Circuit Training Workout shall, where processing Personal Data on your behalf, ensure that it complies with your documented instruction regarding that Personal Data unless the Circuit Training Workout is required to do so otherwise by law. The subject matter, duration, nature and purpose of processing, the type of Personal Data and the categories of Data Subjects are set out at 6.6.
6.3 Circuit Training Workout shall, where processing Personal Data on your behalf:
6.3.1 ensure that any persons authorised to process the Personal Data have committed themselves to confidentiality or are under an appropriate statutory
obligation to confidentiality;
6.3.2 take all measures required pursuant to Article 32 of the GDPR;
6.3.3 make available to you all necessary information to demonstrate compliance with the obligations set out in clause 6.2.
6.4 Circuit Training Workout will process the information you provide for these terms and conditions in accordance with this clause 6.
6.5 Processing your personal data is necessary for the performance of this contract. Circuit Training Workout will use your personal data for the purposes of administering your Membership (including fees and other sums due to us), vetting people applying for the Membership, access control, compiling and administering Circuit Training Workout databases and internal administration such as detection and prevention of crime. We store your personal data in a secure manner. Where the information is sensitive (for example health and medical details) we take extra care of this information and will not pass it to any other parties. We will keep your data for one year after the expiry of your Membership. If you have any questions regarding the processing of personal data or you wish to see your personal data please use our Privacy Tools to download your data or delete your data. Or you can contact [email protected] to request your data, this method may be subject to a fee to meet our costs in providing you with details of the information we hold about you.
7. Limitation of liability
7.1 The member acknowledges that Circuit Training Workout’s obligations and liabilities in respect of Circuit Training Workout activities are defined in this agreement.
7.2 The member is responsible for the consequences of any use of any of the facilities of Circuit Training Workout. Circuit Training Workout will not be liable for any indirect or consequential loss, damage, injury, costs, expenses, theft or damage to property or relating to Circuit Training Workout members, whether arising under contract, tort (including negligence) or otherwise.
7.3 Members will be liable for any wilful or neglectful damage that they cause to Circuit Training Workout equipment.
7.4 Circuit Training Workout accepts liability to the extent that it results from the gross negligence of Circuit Training Workout and/or its partners for death or personal injury. Gross negligence must be proved to have occurred in this instance.
8. Physical health of member
8.1 The member warrants and represents that they are in good health and are not knowingly incapable of engaging in either active or passive exercise including circuit training style exercise. The member further warrants that they know that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
8.2 Before engaging in any Circuit Training Workout sessions the member must read, sign and comply with the Circuit Training Workout Health and Wellbeing Verification Statement.
8.3 You may be refused admission to Circuit Training Workout sessions if Circuit Training Workout considers the use of such sessions could put your health at risk.
9. Membership Fees
9.1 Circuit Training Workout members are required to pay, in advance, the membership fees appropriate to their membership type irrespective of actual usage of Circuit Training Workout sessions.
9.2 The amount you pay depends on your type of membership, as detailed on the Circuit Training Workout website and your Circuit Training Workout membership application.
9.3 Circuit Training Workout reserves the right to increase membership fees at any time, and members will be notified of any changes in advance, in writing.
10. Expulsion of members or termination of membership by Circuit Training Workout.
10.1 Circuit Training Workout may expel members or may terminate the membership of any member:
10.1.1 Without notice and with immediate effect if the member’s conduct, whether or not such conduct is the subject of a complaint by another member or group of members is such that in the reasonable opinion of Circuit Training Workout, the member’s conduct may be injurious to the character, name or interests of Circuit Training Workout or is such that it renders the member unfit to associate with other members of Circuit Training Workout.
10.1.2 Forthwith and without notice if the member shall have committed any breach of these terms and conditions or of the rules, bylaws and regulations of Circuit Training Workout which are in force from time to time or any reasonable breach (as determined solely by Circuit Training Workout) of the rules of the local facility which Circuit Training Workout uses to hold its sessions.
10.1.3 If Circuit Training Workout is of the opinion that the member is not a suitable individual for continuous membership of Circuit Training Workout.
10.1.4 Lapses in membership payment or any other debts to Circuit Training Workout may result in the member not being allowed to use Circuit Training Workout sessions until payment is made.
10.2 A member whose membership is terminated by Circuit Training Workout shall forfeit all privileges of membership with immediate effect without an entitlement to any claim for any refund of their membership or joining fees. On termination of their membership, the member shall immediately return their membership wristband to Circuit Training Workout.
11. Hours of operation
11.1 Circuit Training Workout will normally operate sessions on every occasion stated on the Circuit Training Workout website (except for bank holidays or other public holidays). The days or times of each session may be changed, lengthened or shortened at the absolute discretion of Circuit Training Workout with or without any prior notice being given to members (although Circuit Training Workout shall endeavour to give members reasonable notice of such changes).
11.2 There may be other reasons beyond our control that may result in the suspension of Circuit Training Workout sessions without notice. Where
services offered have been disrupted or compromised on more than three occasions, refunds may be authorised solely at the discretion of Circuit Training Workout.
11.3 The local park/facility which Circuit Training Workout uses to hold its sessions may at times set aside the use of its facilities for tournaments, exhibitions or other events/social activities meaning that it will not be possible for Circuit Training Workout sessions to go ahead. In these circumstances, Circuit Training Workout will endeavour to give members reasonable notice. No refunds will normally be payable in these events.
12. Changes
12.1 Circuit Training Workout may change these terms and conditions from time to time. When changes are introduced we will endeavour to give you reasonable notice of these changes.
12.2 Circuit Training Workout reserves the right to change its charges at any time.
13. Governing law and jurisdiction of the courts
13.1 This agreement shall be governed by and construed in accordance with English Law and the parties hereby agree to submit any disputes to the exclusive jurisdiction of the English Courts.
13.2 These terms and conditions do not create any right enforceable by any person who is not a party to them (‘the third party’) under the Contracts (Rights of Third Parties) Act 1999.
